I<span style="font-family: "helvetica neue light" , , "helvetica" , "arial" , sans-serif;"> know most of you will be discussing the budget that will be presented later this afternoon. And from the stories appearing on my timeline, now is the 30th anniversary of OpsLalang, when many (political) people were detained without trial under the old (now repealed) Internal Security Act. The Prime Minister of Malaysia in 1987 was Dr. Mahathir Mohamed (now generally referred to as "Tun M").</span></div>

Let me tell you my story. Maybe you'll find it interesting. At the very least, I commit it to paper before I forget, or become unable to so do.</div>

I was in Standard 5 when it happened. I knew about it because the teachers at school were talking about it. A classmate's father had been detained. All I knew at the time was that he was a DAP member and a lawyer. That was it. After that, my family started reading the NST instead of The Star. Other than that, save for some noticeable tension in the adults, life went on as usual.</div>

That lawyer who was detained I eventually realised was a senior lawyer in Malacca. He left politics after that, I think. Before he died, I was fortunate enough to assist him in one of his cases. His office was filled with books, a library cum office actually. He challenged the law, prodded it. I was actually proud to say I was from Melaka when we learnt about the case of Allied Bank v. YJH (his case) in Evidence at CLP. I smile every time I remember how we had to use carbon paper to sign letters of demand (lawyers will remember this period fondly, or not). I was also glad I was able to organise his reference (a ceremony at the High Court where lawyers remember their deceased brothers and sisters who passed away while in active practice).</div>

Fast forward many years.</div>

Through a series of funny and painful happenstance, I found myself the head of the defence team at Tun M's Kuala Lumpur War Crimes Tribunal. Some called it a kangaroo court, the less charitable ones called it a mock trial. Whatever it was, that was how I got to know Tun M and Tun Siti. The fun part about them knowing me was that I was then able to organise a public forum in 2015 for the Malacca Bar where Tun M was the keynote speaker.</div>

Now, if this does not trigger you yet, let me explain. After Ops Lalang and the judicial crisis of 1988, the Malaysian Bar had had a falling out (to put it charitably) with Tun M. Do correct me if I'm wrong, but from 1988 until the Malacca Bar's forum in 2015, Tun M was never invited to any Bar function. We (lawyers generally, and obviously, not all lawyers) pretty much didn't like what he did. So it was a big gamble, for me and for the Malacca Bar, to organise that forum. There were so many reasons why it could have gone wrong. Happily, it went on smoothly. And I was glad I helped make it happen. Wounds need to be healed. What can be bygones should be bygones.</div>

And now I come to the meat of this piece.</div>

Ever since Tun M reinserted himself into Malaysian politics, I was uneasy. I cannot speak to his motives, but I have my suspicions. What I do know is this: Although he is the strongest 92-year-old I know (heck, he's even stronger than some 50-year-olds) with a mind to match, Malaysia does not need a nonagenarian leading it (should Pakatan Harapan win). Malaysia is not a two-bit dictatorship. Some would argue it is. Some would even argue that he was the one who made us qualify (or be considered) for that title.</div>

What I know, for sure, is that PR/PH was attractive before they joined forces with him. I know that many of the leaders of PR/PH had actually suffered during his time as Prime Minister of Malaysia; and in contrast, I just have a cute story to tell about what had happened to me when I was in Standard 5.</div>

<br></div>
<div>
Malaysian politics has been defined, shaped, and has grown into what it is today by what he did in his 22 years as PM. And he has much to atone for. Maybe he will, maybe he won't.</div>

What I can do, with my one vote, is to make a point. And I still don't know what is the point I wish to make at the next general election, GE14. Do I support his former coalition which is the devil I know, or do I support his current coalition which is the deep blue sea of uncertainty?</div>

Malaysia, I weep for us. We are asked to choose the lesser of two evils, not the better of two angels. But at least we have a choice — For that, I am thankful. I never thought I would live to see a 2-party system in our country. But I saw its birth in 2008, and its maturity (and degeneration) in 2013 thereabouts.</div>

Is there hope? Yes, of course there is. Either BN or PH is better than Trump. That small grace has been granted to us by God. If only we would put our noses to the grindstone, and not bother Him so much, maybe, just maybe, we can be a great nation that we were destined to be.</div>

The main point he makes in the article is that the convert has rights too, and that has been overlooked, and the solution would be to establish a tribunal where judges from both the civil and shariah jurisdiction can sit and rule on cases such as Deepa's.</span></div><div style="color: #454545; font-family: UICTFontTextStyleBody; font-size: 16px; max-width: 100%;"><span style="background-color: rgba(255, 255, 255, 0);"><br></span></div>

An extra step that can be done to ensure fairness is this: before a conversion is officially registered, the parents (if the convert is not married), or the spouse and children (if the convert is married), should be required by law to be informed of the proposed conversion and be allowed to make representations or objections, and all pending issues must be sorted out before the (proposed) convert is allowed to convert.</span></div><div style="color: #454545; font-family: UICTFontTextStyleBody; font-size: 16px; max-width: 100%;"><span style="background-color: rgba(255, 255, 255, 0);"><br></span></div>

GMAIL. The reason I use the second app is because I need its "defer till
later" function which allows me to put aside unimportant emails which will
reappear in my inbox later in the day, the next day, the weekend, or to a
specific date and time, or (and this is cool but not really useful for me) to a
time when I arrive at a particular place (this is useful when I need, say, a
batch of emails to reappear in my inbox when I arrive at a particular location for
a meeting).</span>

Android, I also have the GOOGLE CALENDAR app running because the
"schedule" view totally works for me.</span></div>

<b>word processing</b>, I use the native NOTES app for quick pieces since basic
formatting is now available. I will only use PAGES when the need arises to edit
the raw text since anything pasted into PAGES is pasted as raw text, while
formatting is maintained when you paste into NOTES. I have not used the MICROSOFT
WORD app after trying it out for a month or two. But it is a good app. When
collaborating with other lawyers, I use GOOGLE DOCS because it allows for
realtime editing with collaborators and we can leave comments for each other.
This speeds up work tremendously.</span></div>

preparing cases, I work mainly with scanned <b>PDF </b>of my files – annotating them
to remind myself of salient points in each case file. I still use PDF EXPERT.
It is, to me, the best app on my iPad. For organising the development for each
case file, I use EVERNOTE and devote 3 notes (usually) per file – chronology,
examination-in-chief/cross-examination flow/questions, and the submission flow.
Each case file gets a specific name, and I do not create individual folders for
each case file. What I do is use tags to remind me what each case is about, for
e.g. statute, court, active or closed case file, area of law, and anything that
will help me tap into research already done when preparing a future case. I use
the tag function as guideposts.</span></div>

convert <b>photos </b>to PDF, I use SCANNER PRO, and I have PDF PRINTER on standby to
convert web pages to pdf (this can also be done with the 'save to PDF in
iBooks' function now available on the latest iOS).</span></div>

still use DROPBOX and GOOGLE DRIVE for my <b>cloud storage</b> needs. iCloud is on by

iPad. Having Telegram on both the iPad and phone is liberating because there is
the option of typing out longer messages (and it's easier to proofread on the
iPad), sending it to myself via Telegram, and then forward to others via
WhatsApp (which is the preferred app for most of the people on my contact
list). There is less chance of typographical errors. I also use ZELLO on
occasion – usually when coordinating large events or outings.</span></div>

Public servants serve the public (collectively). Yes, we are all MEMBERS of the PUBLIC. That does not mean that the OCPD in your area is YOUR SERVANT. That's just dumb. If you think this is in any way remotely true either linguistically or in the real world, then you are dumb. </span></div><div><br></div><div>Public servants are very qualified persons who have gone through rigorous tests and are trusted to work for the good of the nation. That is why they are given very favourable working conditions and a pension. Their service to the nation is highly regarded. Their capabilities are highly regarded. </div><div><br></div><div>They are not your "servants" in the sense of what you understand the word "servant" means. They are not there to wait on you hand and foot. If you think like this, then you are dumb.</div><div><br></div><div>Oh, you may say, "I pay taxes. My taxes pay their salary. So they work FOR ME." Again, you are dumb. You pay taxes because that is your DUTY as a citizen to the nation. That does not make you the boss of the public servants.</div><div><br></div><div>So, to summarise: "Public Servant" is a term for people in the civil service. They are not servants for individual members of the public. They are servants to the nation. And yes, they are also "the public". </div><div><br></div><div>So yeah, if you think you can order or belittle or insult members of the civil service, then you are dumb. And there are laws against such behaviour. I finally know why God allows this issue to not die. It is so that I, and Christians in Malaysia, will VISCERALLY understand <b>Islamophobia</b> and the hurt Muslims feel whenever a sick mad person calling himself/herself a Muslim blows up/shoots at/kills civilians and the entire Muslim community is looked upon suspiciously. </span><br><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;"><br></div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;">I find it annoying and hurtful that there are people who see <b>kristianisasi</b> (the supposedly overt and covert efforts by Christians to convert Muslims to Christianity) everywhere, some bordering on the paranoid delusions of a conspiracy theorist. </div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;"><br></div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;">But in that annoyance and hurt, I forget that there are also many many Muslims (usually minorities in non-Muslim countries) who live under the daily suspicious stares and accusations by their less-enlightened non-Muslim neighbours and fellow citizens just because they wear a hijab, or grow a beard, or pray in a mosque. That must hurt. That must be frustrating. And now I know how it feels. Deep in my heart, I now know how it feels. How it hurts. And an <span style="background-color: rgba(255, 255, 255, 0);">inkling of how scary it can be - <i>I'm speaking generally and painting with a broad brush.</i></span></div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;"><br></div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;">It's not easy being a minority. Not that the spoiler was anything big. Any viewer who has seen the 6 movies could see the twist coming. It wasn't anything big, just "oh c'mon" moment. Nowhere near the gravitas of the reveal at the end of THE EMPIRE STRIKES BACK. </div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;"><br></div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;">What annoyed me the most about this movie (no. 7 in the saga that would have 9 in total) is the [[[LAST CHANCE TO LOOK AWAY BEFORE I SPOIL]]] fact that the 2 main characters know how to use a lightsaber almost as soon as they pick it up. </div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;"><br></div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;">That goes against the logic of the saga. Luke had to learn a bit under Obi-Wan, then a bit more under Yoda (training not completed, that's why he lost to Vader in the first fight); and only after further training by Yoda did he manage to properly fight and defeat Vader. Anakin's story was the same. He had lots and lots of midi-cholrians, but that only allowed him to pilot the pod-racer well (like how Luke could pilot and shoot from an X-Wing well). Anakin had to learn (from Obi-Wan) lightsaber skills between episodes 1 and 2. That took time. </div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;"><br></div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;">But our new heroes, Finn and Rey - all they had to do was pick up a lightsaber, and voila, they can hold their own when taking on Kylo Ren (the bad guy who was obviously trained for some time, and who has considerable control of the Force - he could stop a blaster fire mid-blast, something no one else could do before in the saga). Yeah, this annoyed me a LOT. Finn and Rey should have been cut to pieces by Kylo Ren in seconds. </div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;"><br></div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;">JJ Abrams started this whole "change the logic of the saga" thing with STAR TREK. There, it was the transporter. In the series (and movies before he took over), transporter technology only worked within a reasonable distance (planet to starship, or starship to starship). Not during warp. But we forgave that change because he rebooted the series and made it abundantly clear that it's a different universe in the opening sequence when Kirk's father died. Ok, so that change of saga logic can be swallowed. </div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;"><br></div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;">But Star Wars 7 is not a reboot. You can't just explain away Finn and Rey's lightsaber skills by implying that purely by having a lot of midi-chlorians they immediately know how to use a lightsaber. It does not gel.</div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;"><br></div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;">And this is what annoyed me the MOST about the movie.</div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;"><br></div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;">As a movie, it works - I'll give you that. It brought in key elements from episodes 4, 5, and 6 and nicely packaged them together. </div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;">BB-8, the robot, is brilliant. </div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;">Rey is an amazing character. She is played marvellously. </div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;">Finn, not so much, but good enough. </div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;"><br></div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;">So that's my rant. </div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;">I guess I'm a Trekkar. But my understanding of free speech is, to my horror, vastly different from that of <i>rabble rousers</i>. They think free speech means one can speak the most vile, untruth and uncouth things. That is not free speech. At the very minimum, free speech does NOT permit you to yell "Fire!" in a crowded theatre when there is no fire. <b>Truth</b> should be the ultimate check to free speech. </div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;"><br></div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;">However, not everyone is disciplined (or smart) enough to seek the truth. Many prefer indulging in innuendoes, spreading chain-mails (now emails, and Facebook and Twitter status updates), and plain gossip. That's human nature. That's the state of how we humans are, generally. Even amongst the educated, the learned, the ones who should have devoted their minds to pursuit of the truth, this lapse into our baser human nature happens — sometimes on a daily basis. </div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;"><br></div><div style="color: rgb(69, 69, 69); font-family: UICTFontTextStyleBody; font-size: 16px;">But more than truth, being <b>civilised</b> means being gentle and polite. And there is a difference between objecting or protesting in a civilised manner, and doing so in a less than civilised manner. I will not name examples, but here's how you can spot the difference: Look at people who are passionately opposing a view. Imagine yourself being the object of their passionate opposition. Do you feel <b>threatened</b>, physically or mentally? If yes, then they are a rabble rouser. Right and wrong become mere words, mere labels.</div><div><br></div><div>I didn't know <b>Anthony Kevin Morais</b>. From what I hear and read about him from people who knew him, he was a decent fellow. A hardworking fellow. A good person. A good person who was horrifically murdered most likely because he was doing his job. That was it. Law is both an art (at the higher levels) and a science (at its core). There is no mystery to it. <div>The classic lesson on how to interpret laws is the hypothetical <b><i>“No Vehicle in the Park”</i></b> law.</div><br>
<div>Assume that there is a law stating that no VEHICLE is allowed in the park.</div><br>
<div>It naturally follows that if a vehicle goes into the park, then there would be a breach of this law attracting sanctions (usually this would mean a fine, but it could also include a term of imprisonment).</div><br>
<div>Simple enough so far?</div><br>
<div>Now, this is where the lesson begins: How would you argue for/against (a) person(s) charged with “using a vehicle in the park” in contravention of the clear law stating that there can be “no vehicle in the park” for these 7 separate scenarios. </div><br>
<div><i>1. Adam drives his car through the park to save on commute time.</i></div><i><br>
</i><div><i>2. Garbage trucks coming into the park daily to empty the trash cans placed in the park.</i></div><i><br>
</i><div><i>3. An ambulance with an emergency case cutting across the park because it is the shortest way to the hospital.</i></div><i><br>
</i><div><i>4. Policemen on motorcycles riding through the park in hot pursuit of robbers who ran into the park.</i></div><i><br>
</i><div><i>5. Children riding their bicycles in the park.</i></div><i><br>
</i><div><i>6. A mother pushing her baby in a pram in the park. </i></div><i><br>
</i><div><i>7. Trishaws ferrying tourists on a scenic tour of the park.</i></div><br>
<div>A lawyer would ask 2 questions. </div><br>
<div><b>First</b> question: Is it a vehicle? (i.e. the car, garbage truck, ambulance, motorcycle, bicycle, pram, and trishaw). If it is, go to the next question. If it is not, stop here because there is no contravention of the law. </div><br>
<div><b>Second</b> question: Is there a valid reason for allowing the “vehicle” into the park even though there is a clear law against having vehicles in the park? Putting it in a different way: Should there be exceptions? If yes, why, and when?</div><br>
<div>If you can see the differences in the 7 scenarios and present a coherent argument that would justify your conclusion consistently, you are one step closer to thinking like a lawyer.</div>

Let me put it plainly: An MP is Member OF Parliament. An MP’s job is to ATTEND Parliament when it sits and debate bills before they become law. MPs are the filter before bills become law. If MPs do not attend Parliament when it is in session, it is called “being absent” or “ponteng”. </div>

3. A CONTRITE APOLOGY from ALL the MPs from the 26 who did not attend and who do not have good reasons like, “I was in the hospital/in surgery” or “I was dead.” Don’t even try to give me “official business” as a reason. Your “official business” comes FROM your position as an MP. Do you job as an MP first (i.e. attend Dewan Rakyat sittings). Schedule your “official business” AROUND your attendance at Parliament.</div>

would lead to injustice if the application of hudud were to be continued. So,
he suspended its application. Remember, <b>hudud is only a means, not the end.
The end is justice.</b> Something similar happened in Pakistan in our time.
When the Hudood Ordinance was enacted in 1979, the offence of rape was made a
hudud offence. Subsequently, there were cases of injustice to victims of rape
who became pregnant as a result of it and who could not produce the required
number of witnesses ending in being convicted for adultery. In 2006, the
offence of rape was removed from the Hudood Ordinance and placed under the
Penal Code again and tried by the Civil Court, until now. <b>I am aware that my
speech may disappoint many people. But, if you want to hear my honest opinion
about the reality from the perspective of the Constitution and the law, that is
it.</b> Borrowing the words of Imam Abu Hanifah, "This is only my opinion.
